satisfied and as he seemed anxious for another opinion besides that of the Attorney-General, as apparently he had been advised in a contrary sense to that of the opinion of the Law Officers, I said that I had no objection to his discussing the matter with Mr. Kemp and Mr. E. H. Sharp, K.C. if he wished. He assented to this and as Mr. Sharp kindly consented to advise in the matter a conference took place. I append a note of the opinion which Mr. Sharp expressed and which was explained to Major-General Kelly at the conference held on the 22nd. ultimo.

As Major-General Kelly still strongly desired
on
a reference to the War Office the question I acquiesced in his making one and at the same time I sent you my cypher message of the 25th ultimo paraphrase of which is attached.

It was not considered worth while to obtain kir. Schlüter's rendition on a charge under the Post Office Ordi- -nance, although that might have been done as China is grouped with Hongkong under Article 88 of the China Order in Council 1904, as the penalty is only a fine of $500. An amendment of the law to increase the penalty had already been noted for early enactment.
